Term Of Service

Definitions and Interpretation:

For the purposes of these Terms and Conditions, the following definitions shall apply:

Client/Parent: The individual or legal entity requesting tutoring services from Best Tutors Online. Unless otherwise agreed in writing, the Client shall be deemed to be the person who initially contacts Best Tutors Online to enquire about or arrange tuition.

Lesson: A scheduled period during which a Tutor provides tutoring services to a Student. Each Lesson is subject to the agreed duration, schedule, and applicable fees.

Lesson Fee: The total amount payable by the Client/Parent for a Lesson, including the Tuition Fee and any other charges agreed in advance.

Tuition / Tutoring Service: Any educational or academic support service provided by a Tutor through Best Tutors Online. Tuition may include, but is not limited to, teaching, mentoring, examination preparation, homework assistance, revision sessions, academic guidance, and the provision of learning materials.

Tuition Fee: The fee charged for the tutoring services provided during a Lesson, excluding any additional charges unless otherwise stated.

Tutor: An individual engaged by Best Tutors Online to provide tutoring or educational support services to a Student in return for payment.

Student: The individual receiving the tutoring services. The Student may be the Client or Parent or another person nominated by the Client.

Best Tutors Online: The online tutoring academy providing tutoring services and educational support, referred to throughout these Terms and Conditions as “Best Tutors Online”, “the Academy”, “we”, “us”, or “our”.

Acceptance of Terms and Non-Circumvention

By requesting, booking, or receiving Tutoring Services from a Tutor introduced by Best Tutors Online, the Client and, where applicable, the Parent or Legal Guardian acknowledge that they have read, understood, and agree to be bound by these Terms and Conditions, as amended from time to time.

Non-Circumvention

1. Tutor Restrictions

A Tutor introduced through Best Tutors Online shall not, either directly or indirectly, solicit, approach, accept, or enter into any private tutoring arrangement or other educational service agreement with a Client or Student introduced by Best Tutors Online without the prior written consent of Best Tutors Online.

2. Client Restrictions

The Client and, where applicable, the Parent or Legal Guardian shall not, either directly or indirectly, solicit, approach, engage, employ, contract with, or make payment to any Tutor introduced by Best Tutors Online for the provision of tutoring or related educational services outside the arrangements made through Best Tutors Online without the prior written consent of Best Tutors Online.

3. Circumvention

The Client, Parent or Legal Guardian, Student, and Tutor agree not to take any action intended to circumvent, bypass, or otherwise avoid the involvement of Best Tutors Online in relation to any tutoring services introduced by Best Tutors Online.

4. Breach

Any breach of this clause shall constitute a material breach of these Terms and Conditions and shall entitle Best Tutors Online to exercise any rights or remedies available under applicable law, including, where appropriate, the recovery of any financial loss, damages, costs, or reasonable legal expenses arising from such breach.

Lesson Cancellation, Rescheduling and Non-Attendance

1. Student Non-Attendance / No Show

If the Student fails to attend a scheduled Lesson for any reason, or is unavailable at the agreed date and time, the Lesson shall be deemed to have been delivered, and the full Lesson Fee shall remain payable by the Client. No refund, credit, or replacement Lesson shall be provided unless Best Tutors Online, at its sole discretion, agrees otherwise.

2. Cancellation by the Client

The Client may cancel or reschedule a Lesson by providing written notice to Best Tutors Online.

Where the Client cancels a scheduled Lesson less than twenty-four (24) hours before the scheduled commencement time, other than as a result of a genuine emergency or unforeseen exceptional circumstance accepted by Best Tutors Online, the Client shall remain liable for one hundred percent (100%) of the applicable Lesson Fee.

Where at least twenty-four (24) hours’ written notice is provided, Best Tutors Online shall use reasonable endeavours to reschedule the Lesson, subject to the Tutor’s availability. Rescheduling is not guaranteed.

3. Cancellation by the Tutor

Where a Tutor is unable to deliver a scheduled Lesson due to illness, emergency, technical failure, or any other reasonable circumstance beyond the Tutor’s control, Best Tutors Online shall use reasonable endeavours to notify the Client/Parent as soon as reasonably practicable.

In such circumstances, Best Tutors Online shall, in consultation with the Client/Parent, arrange one of the following remedies:

(a) a replacement Lesson at a mutually convenient date and time;

(b) an alternative Tutor of comparable qualifications and experience, where reasonably available; or

No additional charge shall be payable by the Client for any replacement Lesson arranged pursuant to this clause.

4. Exceptional Circumstances

Best Tutors Online may, at its sole discretion, waive cancellation charges or offer a replacement Lesson where a cancellation arises from exceptional circumstances, including but not limited to serious illness, accident, bereavement, or other events considered beyond the reasonable control of the affected party. The Client/Parent may be required to provide reasonable evidence in support of such circumstances.

Payment

1. Payment of Fees

All Lesson Fees and any other charges payable under these Terms and Conditions shall be paid directly to Best Tutors Online. Under no circumstances shall the Client/Parent make any payment directly to the Tutor.

2. Obligation to Pay

The Client/Parent shall be liable for payment of all Lesson Fees in respect of all Lessons booked, attended, or otherwise payable in accordance with these Terms and Conditions.

3. Payment Due Date

Unless otherwise agreed in writing, the Client/Parent shall pay the applicable Lesson Fees within the first seven (7) calendar days following the commencement of the- booked Lessons. Thereafter, all subsequent payments shall be made in accordance with the payment schedule specified by Best Tutors Online.

4. Method of Payment

Payments shall be made using the payment methods approved by Best Tutors Online. The Client/Parent shall be responsible for ensuring that payment is made on or before the applicable due date.

Best Tutors Online reserves the right to revise its tuition fees at any time. Any change in fees shall not affect Lessons already paid for and shall be communicated to the Client/Parent in writing at least fourteen (14) days before the revised fees take effect.

Refund/Cancellation Policy

Best Tutors Online does not offer refunds for Lessons that have already been taken.

Technology Requirements

The Client/Parents give consent for their child to turn on their camera during online classes.

Students are expected to have a stable internet connection and the necessary equipment for online lessons.

Limitation of Liability

Best Tutors Online shall not be liable for any indirect, incidental, special, or consequential loss or damage arising out of, or in connection with, the provision or use of its tutoring services.

Miscellaneous

1. Best Tutors Online reserves the right, at its sole discretion and without assigning any reason, to require a Tutor to cease providing Lessons to a Client/Parent at any time.

2. The Client/Parents shall not engage the Tutor without the prior written consent of Best Tutors Online.

3. The Tutor shall not record any Lesson or publish any part of a Lesson on any social media platform.

4. Best Tutors Online follows a strict policy of not sharing the Tutor’s or the Client’s/Parent’s contact details, including mobile numbers, email addresses, Facebook, Instagram, and YouTube links, with either party.

5.Best Tutors Online reserves the right to monitor Lessons to ensure the quality of tuition and the safety and security of Students.

6.Best Tutors Online does not guarantee any specific examination results or grades, as academic performance depends on various factors, including the difficulty of the examination, the Student’s preparation, ability, state of mind, health, and overall performance on the day of the examination.

7. Any person under the age of eighteen (18) years shall not register as a user of the Website or use the Website to purchase or arrange Tutoring Services. Where the Student is under the age of eighteen (18) years, the Student’s Parent or Legal Guardian must register on the Student’s behalf and shall be responsible for all obligations arising under these Terms and Conditions.

8. Best Tutors Online reserves the right to reallocate a Tutor’s time slot to another Student if a Student takes an extended break or repeatedly cancels scheduled Lessons.

9. The booking and scheduling of Lessons are subject to availability and may be adjusted with prior notice.
